GMA Summary

PFAS, also known as "forever chemicals" in common parlance, would be defined by this legislation and are a group of man-made chemicals which are resistant to heat, water, oil, and grease. PFAS chemicals have been linked to a variety of health issues. 

This legislation would prohibit liability to any receiver of PFAS for any damages in actions involving a liability claim arising from or related to the intended or incidental use, receipt, or disposal of PFAS. A PFAS receiver is defined in this legislation to mean a person or entity who uses or applies PFAS substances in the manufacture of goods or in agriculture, receives or obtains goods or products containing PFAS, purchases or owns goods or products which contain PFAS, and receives industrial or household waste which contains PFAS.

At least one municipal water system in Georgia is currently in litigation for selling wastewater sludge containing PFAS. Under this legislation, such municipality would be defined as a PFAS receiver and gain some immunities for such sales of wastewater sludge containing PFAS. 

This legislation would not provide any immunity to manufacturers of PFAS.
