House Bill 528 would require high resource use facilities that are anticipated to have a peak energy load of at least 30 megawatts to provide a disclosure report to the Department of Revenue (DOR). The disclosure report for a planned high resource use facility must be submitted no later than 30 days prior to entering into or renewing a contract for receiving a tax incentive or no later than 30 days prior to applying for any governmental permit, approval, or license. The bill requires the disclosure report to contain information related to the high resource use facility's energy usage, water, usage, and community impact including air quality permits, noise levels, and the amount of ad valorem taxes paid in the previous five years concerning the facility.
